{"id":4539,"date":"2016-05-03T10:19:37","date_gmt":"2016-05-03T14:19:37","guid":{"rendered":"http:\/\/www.crto.on.ca\/?p=4539"},"modified":"2016-05-03T10:20:53","modified_gmt":"2016-05-03T14:20:53","slug":"medical-assistance-in-dying-what-if-i-dont-agree-with-it","status":"publish","type":"post","link":"https:\/\/www.crto.on.ca\/fr\/members-blog\/medical-assistance-in-dying-what-if-i-dont-agree-with-it\/","title":{"rendered":"Medical Assistance in Dying \u2013 What if I don\u2019t agree with it"},"content":{"rendered":"<p>Until recently, Medical Assistance in Dying (MAID) had been prohibited in Canada under the <em>Criminal Code<\/em>. \u00a0However, in the Carter v. Canada decision (February 6, 2015), the Supreme Court of Canada found that an absolute prohibition on MAID violated an individual\u2019s legal rights under the <em>Canadian Charter of Rights and Freedoms.<\/em> \u00a0The Charter states that everyone in Canada has the legal right to \u201clife, liberty and security of the person and the right not to be deprived thereof except in accordance with the principles of fundamental justice\u201d<a href=\"#_edn1\" name=\"_ednref1\">[i]<\/a>.<\/p><p>What some healthcare professionals want to know is \u2013 what about my rights?\u00a0 What if MAID conflicts with my moral beliefs and values? \u00a0Well, many of the details are still being worked out but I think we can safely say that those who have a conscientious objection to MAID will not be forced to participate.\u00a0 The Carter decision dealt only with the physician\u2019s role, but it even then it did not compel physicians to provide physician-assisted death if it went against their beliefs. \u00a0It is altogether anticipated that the same will apply to all other health care professionals who could potentially be asked to assist in carrying out a patient\u2019s wish to end their life.\u00a0<\/p><p>When an RT disagrees with the patient\u2019s plan of care, the current expectation is that they do not proceed; however, they must do so in a manner that respects the patient\u2019s dignity and does not impede the individual\u2019s access to optimal care.\u00a0 If all goes as planned, MAID will become another treatment option available to patients, and this will undoubtedly involve RTs as part of the team at times.\u00a0 And so the same principle almost certainly applies to MAID.\u00a0 If an RT objects on moral and\/or religious grounds, s\/he will be required to provide the necessary services until such time care can be transferred to an RT or another healthcare provider.<\/p><p>The federal and provincial governments have until June 6, 2016 to create laws related to MAID in Ontario. \u00a0Many groups and individuals are offering opinions on this issue.\u00a0 Nonetheless, MAID is about to become a legal standard of care that patients will have a right to access &#8211; provided they meet the requisite criteria<a href=\"#_edn2\" name=\"_ednref2\">[ii]<\/a>.\u00a0 Healthcare professionals have rights too.\u00a0 As we continue to move forward it is vitally important that that everyone\u2019s rights are considered and respected.<\/p><p><a href=\"#_ednref1\" name=\"_edn1\">[i]<\/a> Constitution Act (1982).<em> The Canadian Charter of Rights and Freedoms<\/em>.
