{"id":4733,"date":"2016-09-09T14:22:05","date_gmt":"2016-09-09T18:22:05","guid":{"rendered":"http:\/\/www.crto.on.ca\/?p=4733"},"modified":"2016-09-09T14:25:55","modified_gmt":"2016-09-09T18:25:55","slug":"what-happens-within-the-circle-of-care-stays-within-the-circle-of-care","status":"publish","type":"post","link":"https:\/\/www.crto.on.ca\/fr\/members-blog\/what-happens-within-the-circle-of-care-stays-within-the-circle-of-care\/","title":{"rendered":"What Happens Within the \u201cCircle of Care\u201d \u2013 Stays Within the \u201cCircle of Care\u201d"},"content":{"rendered":"<p>We have had Personal Health Information Privacy legislation (<a href=\"https:\/\/www.ontario.ca\/laws\/statute\/04p03\"><em>PHIPA<\/em><\/a>) in Ontario since 2004, and employers regularly emphasise to their staff the perils of indiscriminately viewing personal health records (and conduct random audits to determine compliance). Yet healthcare information privacy violations still occur \u2013 sometimes with very serious consequences for both the patient and the healthcare provider(s) involved. You may have heard about the two healthcare workers who looked into (it is actually officially referred to as \u201csnooping\u201d) the late mayor Rob Ford\u2019s electronic health records \u2013 even though they were apparently not involved in his care.\u00a0 Well, they have become the first in Ontario to be convicted under <em>PHIPA<\/em>. Under the Act, looking at even a single healthcare record of a patient if you are not within their \u201ccircle of care\u201d is considered to be a crime.<\/p><p>Admittedly, <em>PHIPA<\/em> does not define what \u201ccircle of care\u201d means. However, the Information and Privacy Commissioner of Ontario has created the concept of \u201ccircle of care\u201d to guide a healthcare professional when deciding if they are permitted to rely on a patient&rsquo;s implied consent to collect, use, disclose or handle their personal health information\u201d.<a href=\"#_edn1\" name=\"_ednref1\">[i]<\/a>\u00a0 And when you think about it, it really is pretty easy to figure out if you are part of a patient\u2019s \u201ccircle of care\u201d or not.\u00a0 Do you have a direct responsibility for providing care to that individual?\u00a0 If no, then you are not part of their \u201ccircle of care\u201d and have no authority to view their patient records in any way, shape or form.<\/p><p>It always surprises me when I hear that a healthcare professional, while understanding that they are prohibited from looking into a patient\u2019s file if they are not involved in their care, do not appreciate that they cannot use their workplace access to view their own personal health records either.\u00a0 Yet the same \u201ccircle of care\u201d concept applies.\u00a0 Do you have a direct responsibility for providing care (in a medical context) to yourself?\u00a0 Not unless you are taking your own blood samples, doing your own x-rays, making your own diagnosis and developing you own treatment plan.\u00a0 As a patient, you have a right to access your own health records but would need to do so via the same process as any other patient. <br \/> <br \/> Being clear about whether you are in a patient\u2019s \u201ccircle of care\u201d or not is more important now than ever. Bill 119, an Act to amend <em>PHIPA<\/em>, was passed by the Ontario legislature earlier this year with the intent to, among other things, establish clear reporting requirements, increase fines and strengthen processes for prosecution in the event of a privacy breach.\u00a0 In addition, the definition of what it means to \u201cuse\u201d personal health information has now been expanded to mean \u201cto view, handle or otherwise deal with the information\u201d. The inclusion of the word \u201cview\u201d in the revised definition appears to be aimed at preventing \u201csnooping\u201d by those who are outside of the \u201ccircle of care\u201d.<\/p><p>The CRTO has provided a summary of the changes to <em>PHIPA<\/em>, as they apply to RT practice and this can be found <a href=\"https:\/\/www.crto.on.ca\/members\/professional-practice\/changes-to-phipa\/\">here<\/a>.<\/p><hr \/><p><a href=\"#_ednref1\" name=\"_edn1\">[i]<\/a> Information and Privacy Commissioner of Ontario.
